Gardner Halliday (GH) is committed to protecting and respecting your privacy.  This policy sets out how we use, protect and process any information that we collect from you or that you provide to us.  Please read this policy carefully to understand our views and practices regarding your personal data and how we will use it.

For the purposes of data protection legislation in force from time to time the data controller is Gardner Halliday Legal Ltd of 20-22 Wenlock Road.

Who we are and what we do

GH is a recruitment agency and business as defined in the Employment Agencies and Employment Businesses Regulations 2003. We must process personal data so that we can provide recruitment services and in doing so, we act as a data controller.  

We collect the personal data of the following types of people to allow us to undertake our business;

  • prospective and placed candidates for permanent or temporary roles;

  • prospective and live client contacts;

  • supplier contacts to support our services.

What we collect from you

We collect personal data from you directly, such as on the phone, from an application or registration form or via our website or we may collect it from another source such as a jobs board, to the extent relevant and permitted under GDPR legislation.  Subject to this applicable law, we may collect the following information:

  • name and job title;

  • contact information including phone number and email address;

  • links to your professional profiles available in the public domain e.g., LinkedIn and corporate websites;

  • your competences, skills, experience and education;

  • previous employments, educational details and qualifications;

  • other information relevant to roles and your job search; and

  • other information, such as information found from public sources as well as information depending on the position you are applying for, and where necessary for recruitment purposes.

Purpose of processing and legal basis

We will collect and process your personal data for the purposes of providing you with recruitment services, market and salary updates, and to maintain our business relationship with you (either as a client or a candidate).

Our main legal basis for the processing of personal data is our legitimate business interests although we may also rely on contract, legal obligation and consent for specific uses of data.

Legitimate business interests

We introduce candidates to clients for permanent and temporary employment. The exchange of personal data of our candidates and our client contacts is a fundamental, essential part of this process. To support our candidates’ career aspirations and our clients’ resourcing needs we require a database of candidate and client personal data containing historical information as well as current resourcing requirements. To maintain, expand and develop our business we need to record the personal data of prospective candidates and client contacts. 

Due to the nature of our business, we will never store your personal data for a period longer than 6 years without having meaningful contact with you in this time period.  If you have not received any meaningful contact from us in 6 years or more your personal information will be deleted from our systems. Meaningful contact means, for example, any form of contact from us in relation to GH providing recruitment services to you.

We will rely on contract if we are negotiating or have entered into an agreement with you or your organisation or any other contract to provide services to you or receive services from you or your organisation.

We will rely on legal obligation if we are legally required to hold information on you to fulfil a legal obligation.

We will in some circumstances rely on consent for a particular use of your data and you will be asked for your express consent, if required. Examples of when consent may be the lawful basis for processing includes seeking permission to introduce a candidate to a client.

Overseas Transfers

We may from time to time pass your personal data to clients outside the EEA if you have given your explicit consent for us to do so in relation to a role. No personal information is otherwise stored outside of the EEA.

Security and controlling personal data

We are committed to ensuring that your information is secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site and any transmission is at your own risk. Once we have received your information, in order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

We take reasonable steps to keep the personal data we possess accurate and to delete incorrect or unnecessary personal data. This policy provides you with the right to know what personal data we hold about you and to request incomplete, incorrect, unnecessary or outdated personal data be deleted or updated as well as to object to GH’s processing of your personal data on compelling legitimate grounds.

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. We may use your personal information to send you promotional information about roles and market information which we think you may find interesting if you consent for GH to do so.

Data retention

We will retain your personal data only for as long as is necessary. Different laws require us to keep different data for different periods of time.

We have a legal duty to retain accurate data and only retain personal data for as long as we need it for our legitimate business interests, bearing in mind that the long-term relationships with our candidates and clients, and awareness of our candidates’ career histories, are key components of our successful service to you. Accordingly, we have a data retention policy which we keep under review.

Your rights

Please be aware that you have the following data protection rights:

  • the right to be informed about the personal data we process on you;

  • the right of access to the personal data we process on you;

  • the right to rectification of your personal data;

  • the right to erasure of your personal data in certain circumstances;

  • the right to restrict processing of your personal data;

  • the right to data portability in certain circumstances;

  • the right to object to the processing of your personal data that was based on a public or legitimate interest;

  • the right not to be subjected to automated decision making and profiling; and

  • the right to withdraw consent at any time.
